Counsel for the North Delhi Municipal Corporation submits that the petitioners cannot be allowed to vend at the Esplande Road, Cycle Market, Chandni Chowk, Delhi as it is a ‘no-hawking’, ‘no-vending’ zone. Additionally, it is submitted that the petitioners are blocking the free flow of traffic and free movement of pedestrians.
Counsel for the petitioners submits that the petitioners are being singled out and various other similarly situated persons are being allowed to vend.
Mr. Mittal, learned counsel for the respondent North Delhi Municipal Corporation submits that the Corporation has been regularly carrying out drives to remove the unauthorised encroachers on the road and no permission has been granted to any unauthorised street vendor to vend at the site in question. He
submits that the Corporation will continue to ensure that no unauthorised street vendors is allowed to encroach the area and the area will be kept encroachment free.
In view of the stand taken, the present petition stands disposed of, as jointly prayed. CM.APPL 6316/2018 also sands disposed of.
