"It is submitted that a scheme namely, Janani Shishu, Suraksha Karyakaram (JSSK) had been launched on 01.06.2011, under the aegis National Rural Health Mission to eliminate any out of pocket ancillary expenditure incurred by pregnant women, as well as sick newborns accessing public health facilities, for treatment, till 30 days after birth. It is submitted that under this scheme pregnant woman and sick newborns are also entitled to free transport from their home to the Government Health Facility in between health facilities in case of riferral on account of complications in addition to a drop-back home after 48 hours of delivery/treatment. Pursuant to an office memorandum dated 20.02.2013 issued by the Ministry of Health and Family Welfare, Government of India, the entitlements under the JSSK Scheme were extended, to include antenatal and postnatal complications in relation to pregnant women and sick newborns and infants accessing the public health system. In view of there being no separate fund for transport as a sub head under the JSSK Scheme, the transport of the pregnant women and newborns and infants depends on CATS ambulance service. The information regarding free patient transport facility through CATS Ambulances by dialling toll free number 102 is widely disseminated to general public through various popular public health facilities including by ANMs ASHAs and IEC via various Media. "

"It is submitted that the regards the petitioner's contention qua the non availability/difficulty faced by some residents in availing the ambulance services to nearby public health facilities, the same falls under the domain of CATS ambulance service. It is submitted that the while CATS makes every endeavour to respond to all calls made to it but sometimes there is a delay in response or no response. It is further submitted that dissemination of information regarding the availability of the ambulance facility under CATS seems adequate as far as JSSK Scheme is concerned and the Answering Respondent Department is making constant endeavour to improve the awareness in regards the general public at large. It is submitted that in this regards, the non-receipt of benefits under various welfare scheme to the intended beneficiaries is concerned, at times the beneficiaries cannot avail of the same due to failure on their part to comply with the mlmmum documentary requirements as mandated under the scheme. "
