This is a petition under Articles 226 & 227 of the Constitution of India filed by the husband of Richa Malhotra. As per this petition, marriage between the parties was solemnized on 03.11.2016.
Learned counsel for the petitioner submits that on the pretext of going to meet her parents, Richa Malhotra had left her matrimonial home. It is claimed that Richa Malhotra is being illegally detained by her parents.
On an advance copy having been served, Ms.Richa Malhotra has been produced in Court. We have interacted with the petitioner and Ms.Richa Malhotra in the Chamber. Ms.Richa Malhotra submits that she has not been illegally detained by her parents but she does not wish to join the company of her husband. At the same time, the marriage with the petitioner has not been
disputed by Ms.Richa Malhotra. We are informed that Ms.Richa Malhotra was pregnant, but she submits that on account of travelling, the pregnancy has been aborted.
In view of the stand taken by Richa Malhotra, the petitioner does not press this petition. He submits that he would take recourse to such remedy as available in accordance with law.
Accordingly, the writ petition is disposed of as not pressed.
