On further perusal its categorical reply is as follows :
| 1. | As above, the proposal is required to be signed and supported with ownership documents of the owner of ground floor. |
|---|---|
| 2. | The existing plan requires to be signed by the owner of ground floor showing/reflecting extent of deviation at ground floor. |
| 3. | The photographs of the building require to be signed by the owner of ground floor. |
| 4. | The indemnity Bond requires signature of the bonafide owner of ground floor with witnesses. |

In view of above, it is apparent that the proposal in its present form or in isolation cannot be treated and is thus rejected.”
During the course of hearing, Mr. Aroraa, ld. counsel for the respondent submits that he has instructions to state that the ground for rejection of the application in terms of the communication dated 14.1.2016 would not come in the way of processing and allowing the application for regularisation, if, the petitioner satisfies other stipulations attached therefor.
In view of the foregoing, the instant petition is disposed off, with a direction to the respondent-SDMC to proceed further with the processing of the application for regularisation, as provided for under law, within eight weeks from today.
