This is an application seeking correction in paragraphs 6 & 9 of the judgement dated 29.02.2016. It is averred that certain typographical errors have crept in paragraphs 6 & 9 of the said judgement. These typographical errors have been listed out in paragraph 5 of the captioned application.

Accordingly, as prayed, the application is allowed. Consequently, the relevant parts of paragraphs 6 & 9 of the judgement dated 29.02.2016, shall stand corrected as indicated hereafter:

“..6. The scheme, according to Para 1.8, provides for the following share exchange ratio:

“a) 65 (Sixty Five) Equity Shares of Rs. 10/- each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-1.

b) 71 (Seventy One) Equity Shares of Rs. 10/- each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-2.

c) 699 (Six Hundred Ninety nine) Equity Shares of Rs. 10/each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-3.

d) 14 (Fourteen) Equity Shares of Rs. 10/- each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-4.

e) 286 (Two Hundred Eighty Six) Equity Shares of Rs. 10/each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-5.

f) 91 (Ninety One) Equity Shares of Rs. 10/- each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-6.

g) 01 (One) Equity Shares of Rs. 10/- each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-7.

h) 58 (Fifty Eight) Equity Shares of Rs. 10/- each, credited as fully paid-up, of the Transferee Company for every 100 (One Hundred) Equity Shares of Rs. 10 each held in the Transferor Company-8....”

2.1 In paragraph 9 of the judgement, the date of change of name of Parkview Buildhome Pvt. Ltd. in column 3, which is inadvertently mentioned as 12.03.2005, shall be read as 12.01.2005.

2.2 This apart, it is noticed that the change in name qua transferor company no.6 from Dee Dee Telecom Ltd. to Bestech Estate Developers CO.PET. 536/2015 Page 2 of 3

Private Ltd. took effect from 20.04.2015 and not on 30.08.2012, as shown in paragraph 9 of the judgement dated 29.02.2016.

2.3 Though, this prayer has not been made in the application, having regard to the certificate of incorporation appended at page 510, the said correction is directed to be made as well in the judgement dated 29.02.2016. 3. The other parts of the judgement dated 29.02.2016 shall remain unaltered.

The application is, accordingly, disposed of.
