Petitioner is aggrieved by the illegal and unauthorized construction which is being carried out at property no. 2445, Gali Chharre Wali, Chhoti Baradari, Ballimaran, Delhi which is against the byelaws of the Municipal Corporation; submission being that the respondent no.2 (NDMC) is permitting this illegal structure to be carried out by the private respondent (respondent no.1).
On advance notice counsel for respondent no.2 has put in appearance. His submission is that the property was booked on 01.07.2016, on the deviations noted against the sanctioned building plan. A show cause notice was also issued to the private respondent. The demolition order was passed on 22.07.2016. Demolition action
has now been programmed in the first week of October, 2016. His submission that all actions in accordance with law shall be taken is noted. It is hoped and expected that this submission as informed to this Court will be completed in true letter and spirit. Action taken shall be intimated to the petitioner.
No further orders are called for in this petition.
