With the consent of the parties, the matter is being finally heard.

The petitioner, Brigadier, Directorate General of Quality Assurance, is aggrieved by the inactions of the respondents in filling the 3 vacancies in the higher promotional post-equivalent to Major General. The petitioner refers to certain office memorandum of the DoPT dated 08.09.1998 and 23.04.2015 which emphasises the need to stick to time schedule with respect to filling up of the vacancies. It is also stated that the petitioner has made representations to the

respondents on 29.04.15 and 12.06.15 –both of which have not evoked any response.

Learned counsel for the respondents, on instructions, says that having regard to the averments, appropriate orders may be made by the court.

It is evident from the office memorandum relied upon by the petitioner that the question of filling of vacancies which arise from time to time is to be addressed in accordance with the directions. The petitioner has stated that 4 vacancies exist as on date (two on 31.03.2015, one on 30.04.2015, 2015 and last on 30.06. 2015).

In these circumstances, the respondents are hereby directed to act upon the representations addressed by the petitioner to them and take appropriate action at their earliest convenience and in any event within three weeks from today.

The writ petition is disposed of in above terms.
