“ 10.1 To kindly declare the clause 13.2 "Selection of candidates eligible for promotion will be done on the basis of Merit-cum-Seniority for Class-I, Class-II, ClassIII executive officers and Seniority-cum-Merit for other class-III & class-IV officers/employee" in respect of Assistant Engineer of Chhattisgarh State Renewable Engineering Development Agency (CREDA) Employees/ Officers Service Recruitment Conditions Classification & Appeal) Rules, 2004, being ultra-vires to the Article 14 & 16 of the Constitution of India. More specifically is Ultra Virus to the Provisions of Rule 4(1) of Chhattisgarh Public Service Promotion Rule 2003.
10.2 To kindly direct the respondents to consider the candidature of the petitioners for promotion on the post of Assistant Engineer from the post of Sub-Engineer as Seniority Subject to Fitness;
10.3 To grant any other writ/ writs, order/ orders, relief/ reliefs in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioners.”
