At the learned counsel for the petitioner submits that the issue involve in the present Writ petition has already been disposed of by coordinate bench of this Court vide order dated 15/04/2026 passed in WPS No. 3259/2026, therefore, this petition may be disposed of in terms of the order dated 15/04/2026 passed in WPS No. 3259/2026.

Relevant portion of the order dated 15/04/2026 passed in WPS No. 3259/2026 by the coordinate bench of this Court is as under:-

“3. Learned counsel appearing for the State/respondents would submit that earlier the respondent/State had already considered the issue of the petitioners in the light of the

judgment passed by State Administrative Tribunal, Gwalior Bench in Laxmi Narayan Upadhyay v. State of M.P., however, he submits that if the petitioners file a fresh representation, the State will consider their case in light of the notification as mentioned herein above.

In view of the above submissions made by the parties, this petition is disposed of. permitting the petitioners submit fresh comprehensive representation before concerned authorities and if, such representation is submitted, the concerned authority shall consider and take decision on the representation in light of the notification and decision as referred above in accordance with law. expeditiously within a further period of 6 months from the date of receipt of representation.

5. With the aforesaid observation and direction, the writ petition stands finally disposed of.”

Learned counsel for the respondents has no objection to the prayer made by learned counsel for the petitioner.

Considering the submissions made by learned counsel for the parties and in view of the fact that the issue involved in the present writ petition is stated to be covered by the order dated 15/04/2026 passed in WPS No. 3259/2026, this writ petition is disposed of in the same terms.

Accordingly, the petitioner is permitted to submit a fresh comprehensive representation before the competent authority within a period of thirty (30) days from today. In the event such representation is submitted, the competent authority shall consider and decide the same in the light of the notification and the decision referred to in the order dated 15/04/2026 passed in WPS No. 3259/2026, strictly in accordance with law, by

passing a reasoned and speaking order, expeditiously, preferably within a period of six (6) months from the date of receipt of such representation.

It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner and the competent authority shall take an independent decision in accordance with law.

With the aforesaid observations and directions, the writ petition stands disposed of.
