1) By way of this petition, the petitioner has sought following reliefs:-

“10.1 That, this Hon'ble Court, may kindly call for the entire record in relates to the case of the petitioner.

¶24

10.2 That, this Hon'ble Court, may kindly be pleased to issued a writ / or writs / order / or orders / to quashed the impugned order dated 25.06.2021 (Annexure P/1), issued by the Assistant Commissioner, Adiwashi Vikash Jashpur, District: Jashpur Nagar, and reinstate the service of the petitioner with all consequential benefit, in the ends of justice.

10.3 That, this Hon'ble Court, may kindly be pleased to issued a writ / or writs / order / or orders / to direct the respondent Collector, to decide the representation dated 16.11.2021, (Annexure P/9), filed by the petitioner within a stipulate period of time, in the ends of justice.

10.3 That, any other relief, this Hon'ble Court, deem fit and proper may also kindly be granted to the petitioner, in the interest of justice.

10.4 An affidavit in support of this petition is filed herewith.”

2) Learned counsel appearing for the petitioner would submit that the petitioner is a 80% disabled lady who was appointed on the post of permanent Sweeper at Government Girls Ashra, Patiya, Block Manora, District Jashpur vide order dated 10.12.2014. He would

contend that various complaints were made against the petitioner and an enquiry was conducted behind her back. Thereafter, respondent No.2 terminated the services of the petitioner vide order dated 25.6.2021. He would contend that no opportunity of hearing was afforded to the petitioner and therefore, a representation was made before respondent No.2 on 16.11.2021 but till date, the said representation has not been decided. He would submit that a direction may be issued to respondent No.2 to decide the said representation expeditiously strictly in accordance with law.

3) On the other hand, learned counsel for the State would oppose the submissions made by counsel for the petitioner. He would submit that the petitioner was temporarily employed with the Institution on Collector-rate and has no right to retain the post. He would contend that various complaints were received against the petitioner and thereafter, an enquiry was conducted. Pursuant to the enquiry report, respondent No.3 passed order Annexure-P/1. He would submit that the petition deserves to be dismissed.

4) I have heard learned counsel for the parties and perused the documents placed on record.

5) Taking into consideration the relief sought in clause 10.3, wherein a direction has been sought to the Collector to decide the pending representation and also considering the submissions made by learned counsel for the petitioner, this petition is disposed of with a

direction to respondent No.2 to decide the pending representation of the petitioner dated 16.11.2021 expeditiously, preferably within a period of 150 days from the date of receipt of a copy of this order.
