By the present writ petition, the petitioner seeks a direction to the respondent authorities to release family pension and other retiral dues and further seeks a direction to consider and decide her pending representation dated 08.12.2025 (Annexure P/1).

Learned counsel for the petitioner submits that the petitioner's husband, Late Shri Rameshwar Prasad Gayakwad, who was working as Head Master under the respondent department, retired from service on attaining the age of superannuation on 30.06.2018 and thereafter died on 25.11.2025. It is submitted that despite his death, the petitioner's family pension and other retiral dues have not yet been released. Learned counsel further submits that the petitioner submitted a representation dated 08.12.2025 (Annexure P/1) before respondent No.6/Block Education Officer, Balodabazar, District Balodabazar-Bhatapara. However, despite lapse of considerable time, the said representation has neither been considered nor decided by the competent authority, and no order has been passed thereon till date. It is, therefore, contended that the inaction on the part of the respondents is arbitrary and

unjustified, and a direction be issued to the respondent authorities to finalize and release the petitioner's family pension and other admissible retiral dues in accordance with law.

Learned State counsel submits that if the petitioner's representation and her claim relating to family pension and other retiral dues are still pending consideration, the same shall be considered and decided strictly in accordance with law within the stipulated period.

I have heard learned counsel for the parties and perused the material available on record.

Considering the limited prayer made by learned counsel for the petitioner and taking into account the submissions made by learned State counsel, the respondent No.6/Block Education Officer, Balodabazar, District Balodabazar-Bhatapara, is directed to consider and decide the petitioner's representation dated 08.12.2025 (Annexure P/1) relating to her claim for family pension and other retiral dues, and pass an appropriate order, in accordance with law, preferably within a period of 30 days from the date of receipt of a copy of this order.

With the aforesaid direction, the writ petition stands disposed of.
