Petitioner has filed this writ petition seeking following relief:

“ (i) That, this Hon'ble Court may kindly be pleased to allow the petition and quash/set-aside the impugned order dated 02.02.2026 issued by the respondent no.5 (Annexure P-1).

(ii) That, this Hon'ble Court may kindly be pleased to further direct the respondent no.1 to initiate the enquiry in respect of disbursement of the impressed amount of the petitioner as to whether the said amount has been actually paid to the petitioner or not.

(iii) That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the representation pay the amount approximate 5 lakhs with interest within stipulated time, in the interest of justice.

(iii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.”

Learned counsel for the petitioner submits that petitioner had earlier approached this Court by way of filing writ petition bearing WPS No.1223 of 2019 with a prayer to make payment to petitioner towards arrears of Hand-pump Technician Impressed amount. Writ petition was disposed of reserving liberty with petitioner to submit fresh representation before the respondent authority specifying the facts in

tabular form indicating vouchers which are yet to be reimbursed. Accordingly, petitioner submitted detailed representation before the authority along with copy of vouchers. However, vouchers which were submitted by petitioner were not accepted by the authority and have rejected the claim of petitioner observing that petitioner has failed to submit vouchers even after giving several notices to him. He submits that petitioner is ready to submit copy of vouchers for consideration of the authority even today.

Learned counsel for the State submits that according to his instructions petitioner even after several calls has not placed before the authority, the copy of vouchers.

I have heard learned counsel for the parties and perused the documents available on record.

Grievance of the petitioner is that petitioner was not paid Hand-pump Technician Impressed amount while he was in service. In the earlier writ petition filed by petitioner bearing WPS No.1223 of 2019, this Court while disposing of writ petition granted liberty to petitioner to submit representation along with all supporting documents to be considered by the authority, based upon which, respondent authority/Executive Engineer has passed the order dated 02.02.2026 rejecting claim of petitioner on the ground that petitioner had not submitted vouchers in support of his claim. Submission of learned counsel for the petitioner is that petitioner had made an attempt to submit representation which was not accepted and even today he is ready to submit vouchers.

In the aforementioned facts of case, considering the nature of grievance raised, claim of petitioner that he is entitled for amount due and payable to him and he is also having the vouchers but respondent authority have not accepted the same, I am inclined to dispose of this writ petition permitting the petitioner to submit fresh representation, mentioning claim in the tabular form along with all supporting documents enclosing the vouchers and in the event petitioner submits such representation, respondent authority shall consider and take decision afresh on the claim of petitioner.

Let the petitioner submit fresh representation and details of claim in tabular form along with vouchers within a period of 3 weeks and thereafter respondent authority i.e. respondent No.5 is directed to take fresh decision on the claim of petitioner within a further period of 2 months thereafter.

In view of the above observation and direction, impugned order dated 02.02.2026 is hereby quashed.

Writ petition is partly allowed.
