Service law – CISF – Constable Birbal Singh had challenged orders dated 18.12.2021 and 04.01.2022 (Annexures P-1 and P-2) and, separately, letter dated 10.06.2023 and memo dated 17.06.2023 (Annexures P-5 and P-6), besides seeking revocation of his suspension from the post of Constable with attendant benefits. During the writ proceedings, counsel for the respondents informed the Court that vide order dated 25.11.2025, in a different departmental enquiry, the Disciplinary Authority had imposed the penalty of dismissal from services on the petitioner, rendering the petition infructuous. Counsel for the petitioner thereupon sought withdrawal with liberty to challenge the dismissal order and to assail the orders impugned in this writ petition should the removal matter conclude favourably. There being no objection from the respondents, Rakesh Mohan Pandey, J., dismissed the petition as withdrawn with the aforesaid liberties (NAFR). No issue was adjudicated on merits; the observations of respondents' counsel regarding the dismissal order are a submission, not a finding of this Court.

The petitioner has filed this petition seeking the following relief(s):-

“ 10.1 That the Hon’ble Court may kindly be pleased to issue writ in the nature of certiorari and quash order dated 18.12.2021 (Annexure P-1) and 04.01.2022 (Annexure P-2)

10.2 That, this Hon’ble Court may kindly be to direct the respondent authority to revoke the suspension of the petitioner to the post Constable as per merits and shall provide all such benefits that the enjoyed by the virtue of his position as Constable in CISF.

10.3 That, the Hon’ble High Court may kindly be pleased to issue writ in the nature of certiorari and quashed letter dated 10.06.2023 (Annexure P-5) and memo dated 17.06.2023 (Annexure P-6).

10.4 That, this Hon’ble Court may be further pleased to pass any other consequential and other orders/ writs which this Hon’ble Court deems just and proper in the facts and circumstances of the case.

Learned counsel appearing for the respondents would submit that vide order dated 25.11.2025 in a different departmental enquiry, penalty of dismissal from services has been passed against the petitioner by the Disciplinary Authority and thus, this petition has become infructuous.

At this stage, learned counsel appearing for the petitioner would seek permission of this Court to withdraw this petition with liberty to challenge the subsequent order. She would further seek liberty to assail the order impugned of this writ petition, if favourable order is passed in the matter of removal from services.

No objection from other side.

Accordingly, the petition is dismissed as withdrawn with the aforesaid liberty as stated above.
