Counsel for the petitioner fairly submitted that the issue involved stood decided in WPS No. 1082 of 2023 vide order dated 31.01.2026, by which that writ petition was dismissed, and counsel for the State concurred that the present case was covered thereby. In WPS No. 1082 of 2023 this Court had held that an appointee on compassionate ground to a Class-III post, required as a condition precedent to obtain a one-year Diploma/Certificate in Data Entry Operation and pass a Hindi Typing Test at 5000 key depressions per hour, who cleared the skill test only on 09.12.2021, was rightly regularized with consequential benefits w.e.f. 13.12.2021, and that the claim for benefits from the initial date of appointment was without merit and called for no interference. Accordingly, the present writ petition was dismissed in terms of the order passed in WPS No. 1082 of 2023.

Learned counsel for the petitioner fairly submits that the issue involved in this petition has been decided in a writ petition bearing WPS No. 1082 of 2023 vide order dated 31.01.2026 and the writ petition filed by petitioner therein has been dismissed.

Learned counsel for State also submits that the case of petitioner is covered with above mentioned writ petition.

This Court while disposing of the writ petition bearing WPS No. 1082 of 2023 on 31.01.2026 has observed as under:-

“7. From a bare perusal of the record, it is quite vivid that he petitioner was appointed on compassionate ground to a Class-III post, subject to the condition that he obtain a one year Diploma/Certificate in Data Entry Operator and pass a Hindi Typing Test with a speed of 5000 key depression per hour on the computer. Passing this skill test constituted a condition computer. Passing this skill test constituted a condition precedent which the petitioner failed to fulfill within the prescribed period. As the petitioner cleared the skill test only on 09.12.2021, he has rightly been considered for regularization and other consequential benefits w.e.f. 13.12.2021.

8. Considering the facts and circumstances of the case, in the opinion of this Court, the contention of the petitioner that he should have been granted benefits from the initial date of appointment is without merit and cannot be accepted. The grievance raised by the petitioner, therefore, could not be redressed. The respondents have rightly granted regularization and other service benefits with effect from 13.12.2021 which in view of this Court, is correct and does not call for any interference.”

In view of the submission made by learned counsel for petitioner, this writ petition is also dismissed in terms of order passed in WPS No. 1082 of 2023.
