The petitioner has filed this Writ Petition seeking following reliefs:-

“10.1 That, the Hon'ble court may kindly be pleased to quash/set-aside the order dated 1301-2023 (Annexure P-1) passed by respondent No.2, in the interest of justice.

10.2 That the Hon'ble Court further pleased to grant such other relief(s) as may be deemed fit and proper in the interest of justice and fair play.”

At the outset, learned counsel for the parties submit that the issue involved in the present writ petition stands squarely covered by the judgment rendered by the co-ordinate Bench of this Court in WPS No. 6423 of 2010 (Prem Narayan Sengar vs. State of Chhattisgarh and others) decided on 27.07.2021 . It is jointly prayed that the present writ petition may also be disposed of in terms of the observations and findings recorded therein. The relevant paragraphs of the said judgment are reproduced below:–

“6. This Court in the matter of Rajkumar Gonekar (supra) held as under:-

"3. In view of the above, this petition is allowed. Impugned order is set aside only on ground

of violation of principles justice, though with liberty respondent to afford opportunity of hearing and natural pass fresh order.

4. The petitioner for all legal and practical purposes shall be treated as having continued on the post of Dy. Director."

7. In that view of the matter, the instant writ petition is allowed in terms of paras-3 and 4 of the order passed in Rajkumar Gonekar (supra) and the impugned order dated 7.8.2010 (Annexure P-1) is hereby set aside. The matter is remitted to the respondent authority to pass afresh order after hearing the petitioner in terms of order passed in Rajkumar Gonekar (supra). No cost(s). ”

Since the grievance of the petitioner is identical to the one considered in WPS No. 6423 of 2010 (Prem Narayan Sengar vs. State of Chhattisgarh and others) decided on 27.07.2021 , and the petitioner in the present case is also seeking the same relief, the writ petition is accordingly disposed of in terms of and in line with the aforesaid judgment.
