10.2 This Hon’ble Court may kindly be pleased to direct to the concerned respondents to pay the amount of petitioner’s earned leave encashment for her service period from 05.01.1989 to 31.08.2020 i.e. 31 years 7 months and 27 days and further be directed to pay her remaining group insurance amount of Rs. 39.113/-

10.3 That, this Hon’ble Court may kindly be pleased to pass any other writ(s), order(s) or direction(s) which the Hon’ble court deems just and proper in the facts and circumstances of the case;

Learned counsel for petitioner submits that petitioner while working on the post of Mess Servant (non-setup) in Chhattisgarh Institute of Medical Sciences (CIMS Hospital Bilaspur) got retired from service on 31.08.2020 completing 31 years 07 months and 27 days. He submits that though some retiral dues have been paid to petitioner but the group insurance as also the leave encashment dues have not been paid for which she is entitled for. Petitioner has submitted representation before respondent no. 2 on 10.07.2024 vide Annexuer P-1 which till date is pending consideration, therefore, direction be issued to respondent no. 2 to consider and take decision on pending representation at the earliest within specified time frame.

Learned counsel for the State submits that in view of limited prayer made by learned counsel for petitioner he is having no objection.

On due consideration of submission made by learned counsel for respective parties, nature of grievances raised and further considering the fact that representation has been submitted by petitioner on 10.07.2024 vide Annexuer P-1, this writ petition at this stage is disposed of permitting petitioner to submit fresh comprehensive representation along with all the supporting documents before respondent no. 2 and in the event petitioner submits such representation, concerned authority shall consider and take decision on the representation submitted by petitioner, in accordance with law, expeditiously, preferably within a further period of three months from the date of receipt of the representation.

With the aforesaid observation and direction this writ petition stands disposed of.
