This second bail application is filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 153/2018 registered at Police Station – Patewa, District – Mahasamund, Chhattisgarh for the offences punishable under Sections 420, 34 of the Indian Penal Code, 1860, under Sections 3, 4, 5, & 6 of the Prize Chits and Money Circulation Scheme (Banning) Act, 1978 and under Sections 3, 4, 5 and 10 of the Chhattisgarh Protection of Depositors’ Interests Act, 2005.

Case of prosecution is that, complaint lodged by Chandrashekhar Dewangan and other alleging that person engaged by B.N. Gold Real Estate and Allied Company Ltd., have executed bonds and collected huge amount from the local peoples including him on the assurance of giving their deposited amount double within short period, however, after maturity of amount, it was not returned back to the complainants. The amount deposited was Rs. 1,80,000/- of which bond papers were also issued by the company. It is also alleged that the chit fund companies have been restricted to run their business from the year 2014, however, the amount has been collected on 13.02.2016. Based on the report/complaint, initially crime was registered for alleged offence as mentioned above in the cause title against Directors of the company.

This Court vide order dated 14.08.2025 in M.Cr.C. No. 6429/2025 considering the submission of learned counsel for respective parties in particular, submission of learned counsel for the Respondent/State that the applicant is shown as one of the Directors in the Article of Association and the nature of offence as also the fact that the applicant, after registration of the crime, absconded had dismissed the application on merits. After dismissal of the application on merits, the applicant had preferred Special Leave to Appeal before the Hon’ble Supreme Court in Special Leave to Appeal (Cr.) No. 18622/2025 which came to be dismissed vide order dated 26.11.2025.

Learned counsel for the applicant made an attempt to submit that this second bail application is filed due to to change in circumstances as the petitioner has enclosed the copy of Form 32 and resignation letter which appears to have been obtained from police station.

On the other hand, learned State counsel also submits that document which is filed by the applicant at Page No. 32 was already part of the

case-diary at the time of consideration and rejection of the first bail application.

Taking into consideration, facts and circumstances of the case, nature of allegations, submission of learned counsel for the respective parties, documents enclosed along with the bail application, I do not find present to be a fit case to allow the application for grant of bail.

Accordingly, the bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is dismissed at the admission stage. Certified copy as per rules.
