When question is posed to learned counsel for petitioner as to why this second writ petition is maintainable on the same issue when earlier writ petition filed by petitioner seeking similar reliefs was dismissed in WPC No. 2464/2019 decided on 05.10.2020, learned counsel for petitioner submits

that as the decision in the earlier writ petition is erroneous to the law applicable to the case, this second writ petition is filed.

After arguing for some time, learned counsel for petitioner submits that he may be permitted to withdraw this writ petition with liberty to avail other alternate remedy available to him under law.

In view of above submission made by learned counsel for petitioner, this writ petition is dismissed as withdrawn with liberty as prayed for.
