By way of this petition, the petitioner has prayed for following

reliefs:-

“10.1 To call for the records of the case for the kind perusal of this Hon'ble Court.

10.2 To issue an appropriate writ or order quashing the order No. 356/na. pa. Ni./a aaka/2024-25 dated Ni./a 14.01.2025 and order No. 384/na. pa. aaka/2024-25 dated 15.01.2025 (Annexure P/2).

10.3 To issue an appropriate writ or order quashing the order No. 713/na. pa. Ni./a aaka/2024-25 and order No. 773/na. pa. Ni./a aaka/2024-25 18.03.2025. (Annexure P/3).

10.4 To issue an appropriate writ / order or direction to the respondent authorities to provide the details regarding the demand and basis and calculation on which the payment has been demanded by the Res.No. 3.

10.3 Any other relief deemed fit in the facts and circumstances of the case may also be granted.”

Learned counsel for the petitioner submits that the present writ petition was filed on 09.05.2025, being aggrieved by the action of the Municipal Corporation, Bilaspur, whereby the petitioner was

directed to deposit a sum of Rs.4,60,487/- within a period of seven days towards alleged arrears of rent in respect of each of the two shops, bearing Shop Nos. 19 and 26, situated at New High-Tech Bus Stand, Tifra, Bilaspur. He further submits that the aforesaid demand notice has been issued without furnishing any detailed calculation or statement of accounts indicating the manner in which the alleged outstanding amount has been arrived at. In the absence of any such calculation or break-up of the alleged arrears, the petitioner has preferred the present writ petition challenging the said demand notice. Learned counsel for the petitioner further submits that the matter has been mentioned for urgent hearing as the shops in question had been sealed by the concerned authorities of the Municipal Corporation, Bilaspur. He submits that the petitioner is ready and willing to deposit the legally payable rent and has no intention of avoiding his lawful liability; however, the Municipal Corporation may be directed to furnish a detailed calculation and complete break-up of the alleged outstanding rent, clearly indicating the period for which the rent has remained unpaid and the basis on which the amount has been calculated. It is contended that the impugned recovery notice has been issued without furnishing any calculation whatsoever. Learned counsel further contends that the rent in respect of the shops in question has also not been assessed or charged in accordance with law. According to the petitioner, similarly situated shop occupants are being charged rent at the

rate of approximately Rs.4,500/- per month, whereas, in the petitioner's case, the demand appears to have been raised at an exorbitantly higher rate without any justifiable basis. Learned counsel further submits that the petitioner has already deposited a sum of Rs.70,000/- with the Municipal Corporation only yesterday and, upon such deposit, the respondent authorities had assured the petitioner that the seals affixed on the shops would be removed and the shops would be opened today itself. In view of the aforesaid subsequent development, learned counsel for the petitioner submits that, at this stage, the present writ petition may be disposed of by directing the Municipal Corporation, Bilaspur, to consider and redress the grievance raised by the petitioner. The petitioner undertakes to submit an appropriate application/representation before the Municipal Corporation pointing out the discrepancies in the calculation of arrears of rent. He further submits that the petitioner is also ready and willing to deposit such further amount towards the outstanding dues as may be found legally payable upon proper calculation and determination of the arrears in accordance with law.

On the other hand, learned counsel appearing for the Municipal Corporation, Bilaspur, submits that the seals affixed on the shops in question have already been removed and, therefore, the only surviving issue pertains to the determination and payment of the outstanding rental dues.

Having regard to the submissions made by learned counsel

appearing for the parties and considering the facts and circumstances of the case, the Municipal Corporation, Bilaspur, is directed to furnish to the petitioner a detailed calculation and break-up of the outstanding rental dues in respect of the shops in question. Upon receipt of the said calculation, the petitioner shall be at liberty to submit an appropriate application/representation before the competent authority of the Municipal Corporation seeking rectification of any discrepancy in the calculation of the arrears of rent. If such an application/representation is filed by the petitioner, the competent authority of the Municipal Corporation, Bilaspur, shall consider and decide the same, strictly in accordance with law, within a period of 30 days from the date of receipt of a copy of this order.

Thereafter, the petitioner shall continue to deposit the current monthly rent regularly, in addition to the amount of arrears/outstanding dues as may ultimately be determined to be legally payable by him. The Municipal Corporation, Bilaspur, is further directed to consider and fix appropriate and reasonable instalments for payment of the arrears of rent, so as to enable the petitioner to clear the outstanding dues in a phased manner.

With this observation and direction, the writ petition is disposed of .
