By way of this petition, the petitioner has prayed for following reliefs:-

“10.1 That the Hon'ble Court may kindly be pleased to direct the respondent authority to allotment of that particular land in which is petitioner is in possession i.e. Khasra No. 574, rakba 0.05 decimal land situated at village Bogatola under the Scheme of Rehabilitation of the State Government to the petitioner.

10.2 That the Hon'ble Court may kindly be pleased to direct the respondent No. 2 to decide the pending representation dated 04.05.2026 within stipulated time for redressal of the grievance of the petitioner.

10.3 Any other relief, which may deem fit, in the interest of justice.”

Learned counsel for the petitioner submits that the petitioner has filed an application for settlement of the land, in which, he is in possession before the concerned Authority, however, till date said application has not been considered. He further submits that the petitioner has been in peaceful possession and occupation of the land in question for the last 30–40 years, where he has been residing along with his family. It is further submitted that the petitioner has already made a detailed representation/application

before respondent No. 2 seeking regularization of his possession and has categorically expressed his willingness to pay all requisite charges, premium, or other amounts as may be determined by the competent authority for such regularization. Despite the submission of the said application and the petitioner's continuous possession of the land, the respondent authorities have neither considered nor decided the same, and the application continues to remain pending without any justifiable reason. It is, therefore, submitted that the inaction on the part of the respondent authorities has constrained the petitioner to invoke the extraordinary jurisdiction of this Hon'ble Court by filing the present writ petition seeking appropriate relief.

Learned State Counsel submits that circular dated 11.09.2019 issued by the State Government is not in existence, however, a new Gazette notification dated 14^th July 2022 has come into effect and the petitioner has to file an appropriate application before the concerned Authority.

Having heard learned counsel for the parties and perused the material available on record.

Considering facts of the case, nature of relief, submissions of counsel for the parties, the instant petition stands disposed of permitting the petitioner to file an appropriate application before the Authority concerned within ‘15 days’ from the date of receipt of copy of this Court.
