1. Heard Mr. Mukul Chaturvedi, learned counsel for the petitioner.

2. The present transfer petition has been filed seeking transfer of the proceedings pending before the III Additional Principal Judge, Family Court, Durg, District Durg (C.G.) Case bearing No. CS-A/649/2025, to the Family Court, Rajnandgaon, District - Rajnandgaon (C.G.).

Learned counsel for the petitioner submits that it is highly inconvenient and practically difficult for the petitioner to attend the Court proceedings at Durg, as she is residing at Rajnandgaon and is required to travel for every hearing. It is further submitted that repeated travel causes physical, mental, and financial hardship to the petitioner, who has no independent source of income and is dependent upon her aged parents for her livelihood. submits that the petitioner is solely responsible for the upbringing, education, and welfare of her two minor school-going children residing with her at Rajnandgaon. According to the petitioner, regular travel to Durg would adversely affect the children's studies and daily routine. Hence, a prayer has been made for transfer of the proceedings from Family Court, Durg, to Family Court, Rajnandgaon.

4. I have heard learned counsel for the petitioner and perused the pleadings and documents available on record.

5. Upon consideration of the facts and circumstances of the case, it is noticed that the distance between Durg and Rajnandgaon is approximately 25 kilometers only. In the opinion of this Court, the said distance does not constitute such an exceptional hardship as would warrant transfer of the proceedings. However, the petitioner shall be at liberty to avail herself of such facilities as may be permissible under law, including participation through video conferencing, if available, in accordance with the applicable rules and directions issued by the concerned Family Court.

6. In view of the aforesaid, no case for transfer is made out. Accordingly, the present transfer petition stands disposed of . However, the petitioner shall be at liberty to seek appropriate relief regarding appearance through video conferencing before the concerned Court, which shall be considered in accordance with law.

7. Accordingly, I.A. No.02/2026, application for urgent hearing and I.A. No.03/2026, application for hearing during summer vacation, stand disposed of.
