1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of bail to the applicant in Crime No.73/2025 registered at P. S. Kusmi, District Balrampur-Ramanujganj (C.G) for the offences under Sections 7, 8 of POCSO Act and 74 of BNS Act, 2023.

2. As per the prosecution case, on 23.08.2025 the Principal of Govt. Eklavya Model Residential School, Kusmi lodged a complaint against the present applicant alleging that some girl students of his school have informed him that on 25.08.2025 when they were going in the bus to attend some event along with three teachers, the applicant who is working as a guest teacher (music) had put his hand on the back and shoulders of some girls and was trying to talk to them indecently which the girls found inappropriate and reported to the Principal. On the basis of the report given by the Principal of the School, the FIR was registered against the applicant for the aforesaid offences.

Learned counsel for the applicant submits that there are three victim girl students in this case; all they have been examined before the trial Court and have turned hostile to the prosecution case. He submits that the applicant is in jail since 23.08.2025 and the trial is likely to take time, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application. 5. On 15.12.2025, the victims have appeared through VC from the concerned DLSA and have not raised any objection to granting bail to the applicant.

6. Having considered the submissions made by learned counsel for the parties and on perusal of the court statements of the victim girls , without observing anything on merits of the case, I am inclined to release the applicant on bail.

7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on furnishing a bond in sum of

Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the said Court as and when directed in that behalf.
