No.0753/2025 registered at Police Station – Kota, District – Bilaspur, Chhattisgarh for the offence under Section 103(1) of the BNS, 2023.

According to the prosecution case, on 28.07.2025 a dispute arose between the present Applicant and the deceased Mangli Ram over a towel, during which the Applicant allegedly threw a cement brick at the chest of the deceased, causing him to collapse and later die at Jan Swasthya Kendra, Ganiyari. Based on the said allegation, the aforementioned offence was registered against the present Applicant. Hence this application.

Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. She further submits that one of the witnesses has not supported the case of the prosecution and turned hostile. She lastly submits that the Applicant is an aged person, who is in jail since 29.07.2025 and the trial is likely to take considerable time for its conclusion, therefore, he may be enlarged on bail.

Per contra, learned Counsel for the State opposed the bail application and submitted that the Applicant has been named in the FIR and eye-witness namely Ramnarayan Suryavanshi has not been examined.

Having considered the submissions made by learned Counsel for the parties and the facts and circumstances of the case, further considering the nature of allegation and also considering that name of the Applicant finds place in the FIR and eye-witness Ramnarayan Suryavanshi has not been examined, without further commenting anything on the merits of the case, I am not inclined to release the Applicant on regular bail.

Accordingly, the bail application is rejected. However, looking

to the custody period of the Applicant, the concerned trial Court is directed to expedite the trial as early as possible.
