The Applicant, in custody since 11.11.2025, stands implicated in Crime No. 355/2025 of P.S. Dongargaon, District Rajnandgaon, for the offence under Section 103(1) of the BNS, 2023, arising out of the death of Angeshwar, who went missing on the night of 09.11.2025 and whose dead body was recovered from the well of Radhe Satnami at Village Bhargaon Khar. According to the prosecution case, the deceased Angeshwar went missing on the night of 09.11.2025 and subsequently his dead body was recovered from the well of Radhe Satnami situated at Village Bhargaon Khar. Based on the aforesaid allegations, offence as mentioned above, has been registered against the present Applicant. Hence, this application.

Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. He further submits that the case is based on the last seen theory, the blood stains recovered from the axe do not match with the blood of the deceased and the dead body was recovered from an open place. He lastly submits that the Applicant is in jail since 11.11.2025 and the trial is likely to take considerable time for its conclusion, therefore, he may be granted bail.

Per contra, learned Counsel for the State opposed the bail application and submitted that sufficient evidence has been collected against the Applicant, therefore, he is not entitled to be released on bail.

Having considered the submissions made by learned Counsel for the parties and the facts and circumstances of the case, further considering that trial has not commenced and sufficient evidence has been collected against the Applicant, without further commenting anything on the merits of the case, I am not inclined to release the Applicant on regular bail.

Accordingly, the bail application is rejected.
