The applicants have preferred this 1^st bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as they are arrested in connection with crime No. 08/2026, registered at Police Station – Trikunda, District- BalrampurRamanujganj (C.G.) for offence punishable under Sections 74, 3(5) of BNS and Sections 7, 8 of the POCSO Act, 2012.

In this case there are two victims. The prosecution's case, in short, is that on 26.01.2026, the applicants herein along with one other juvenile accused tried to outrage the modesty of victim A and when victim B tried to intervene, she sustained scratch marks during the incident. Based on above, offence has been registered against the applicants and they were arrested on 28.01.2026.

Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the crime in question. The victims and the applicants are relatives. The victim A has not supported the case of prosecution in her statement recorded under Section 164 of Cr.P.C. The applicants are in jail since 28.01.2026. There are total 14 prosecution witnesses, the charge-sheet has been filed on 15.02.2026 and the trial is likely to take time to be finalized, therefore, it is prayed that the applicants may be enlarged on bail.

Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that at the time of incident, the victim was minor, therefore, looking to the nature of offence, the applicants may not be released on bail.

I have heard learned Counsel appearing for the parties and perused the material available on record.

Considering the facts and circumstances of the case, evidence collected by the prosecution, detention period of the applicants and the fact that the trial is likely to take some time to be finalized, without commenting on merits of the case, I am inclined to release the applicants on bail.

Accordingly, the bail application is Allowed .

It is directed that the applicants shall be released on bail on executing a personal bond for a sum of Rs. 20,000/- each with one surety for the like sum to the satisfaction of the Trial Court for their appearance before the said Court as and when directed.
