Applicants have preferred this MCC for restoration of Second Appeal No. 698/2003 which was dismissed by this Court vide order dated 14-2-2025 for want of prosecution.

Learned counsel for the applicants would submit that, SA No. 698/2003 was listed for hearing on 14-2-2025, but in the cause list published by the Registry for that day, names of Advocates who had left representing the appellants, were published and name of present Advocate (Mr. Anoorup Panda) of the appellants was not published, therefore, the Advocate representing them was not present when the case was taken up for hearing. Thus, non-appearance of appellant’s counsel was bonafide, hence it is prayed that the instant MCC be allowed and the SA No. 698/2003 may be restored to is original number.

Learned counsel for the respondents raised objection to allow the MCC.

On due consideration and for the reasons mentioned in the MCC for non-appearance of the appellants’ counsel, instant MCC is allowed. The impugned order dated 14-2-2025 is set aside. Registry is directed to restore SA No. 698/2003 (Pardesilal and anr. Vs. Nirabai and ors.) to its original number.
