1. Heard Mr. Tarun Dansena, learned counsel for the petitioners. Also heard Ms. Vaishali Mahilong, learned Deputy Government Advocate appearing for respondent / State.

2. The petitioner has filed this petition praying for following relief:-

“a. That the Hon'ble Court may kindly be pleased to call for the entire records pertaining to the Criminal Case No. 6249/2022 for perusal of this Hon'ble Court.

b. That, the Hon'ble Court may kindly be pleased to quash the criminal proceeding before the learned Judicial Magistrate First Class, Bilaspur in Criminal Case No. 6249/2022 and registered FIR No. 29/2022 under section 498-A/34 of Indian Penal Code and charge sheet (Challan no. 51/2022) filed by the police station - Mahila Thana, Bilaspur, District Bilaspur (C.G.).

c. Any other relief may also be granted to the applicants which this Hon'ble Court deems fit in facts and circumstances of the case.”

From perusal of the present petition, it transpires that though the order framing charge has been annexed with the present petition, but the same has not been challenged and without making any prayer for quashing of the same, the learned counsel for the petitioner has drafted a vague and sketchy prayer.

4. Learned counsel for the petitioner prays to withdraw the petition with the liberty to file a duly constituted petition with an appropriate prayer.

5. Accordingly, this petition is dismissed as withdrawn , with liberty to file petition afresh with appropriate prayer and pleadings.

6. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
