This is a Suo Moto Contempt Case arising out of order dated 11.09.2025 passed in WPC No. 1507 of 2020 which was dismissed as withdrawn by this Court.

Vide order dated 13.07.2020 passed in WPC No. 1507 of 2020, after considering the aforesaid facts and circumstances, this Court prima facie is of the view that the action on the part of the District Collector as well as the Respondent No. 3 amounts to gross contempt and this Court was compelled to initiate suo moto contempt proceeding against the District Collector- Bemetara, Shiv Anant Tayal the proposed Respondent No. 5 in the writ petition, so also against the Respondent No. 3, Renuka Ratre, Tahsildar Navagarh District-Bemetara, (CG) the proposed Respondent No. 6 by name in the present writ petition. The Respondent No. 5 and 6 who are present before this court were granted two weeks' time to submit their explanation as to why charge should not be framed against them under the provisions of Contempt of Courts Act. Registry was directed to register a separate suo moto contempt case against the respondent no. 5 & 6 and shall list the case along with this case when it is next listed. Let the two orders in this writ Petition dated. 10-07-2020 & 13-07-2020 be made part of the record of the suo moto contempt case record also.

Learned counsel for respondent No. 2, currently posted as Deputy Collector, District Khairagarh Chhuikhadan-Gandai (C.G.) in his additional affidavit filed on 27.03.2023 submitted that due to inadvertent and bona fide action of the answering respondent, the demolition drive took place and the demolition of the subject property was done on 10.07.2020 since the communication of the order not reached on time to her. It is further submitted that currently a proposal was communicated to Krishna Dhruw, the

aggrieved person by Chief Excecutive Officer, Janpad Panchayat, Navagarh, District-Bemetara vide letter dated 16.02.2023 in which it was informed to him that in place of his demolished shop, a shop which will be constructed in a new complex will be allotted to him and the aggrieved party has also given the consent that the construction cost will be borne by him. The proposal of the same has also been passed in the meeting dated 29.09.2021 conducted by the Cooperative and Industries Committee, Janpad Panchayat, Navagarh, District-Bemetara (C.G.). Copy of the letter communicated to Krishna Dhruw, the aggrieved person by Chief Executive Officer, Janpad Panchayat, Navagarh is 16.02.2023 which was marked as Annexure R-2/7. He further submits that as per the knowledge of the answering respondent, the aggrieved party is currently operating his shop in a private property which is totally managed by him. On 11.08.2023, it was directed to respondent No. 02 that she shall specifically mention as to the area on which the shops were constructed, nature of construction and as to under what scheme and manner, the petitioner in writ petition was allotted the shop and payment. Subsequently, in compliance of the said order, she filed an additional affidavit on 03.09.2023 wherein she mentioned all the details as questioned by the Court. Therefore, he prays that the petition may be disposed of in light of the above additional affidavits as given by the concerned officer.
