The petitioner, an employee of the Education Department serving diligently at Govt. High School, Sargawan, is aggrieved by her sudden transfer on 30.09.2022 to Govt. High School, Fatehpur, allegedly on administrative exigency. However, the petitioner contends that the transfer was made to facilitate another employee rather than any genuine administrative need. Despite her representation dated 14.10.2022 seeking cancellation of the transfer, no decision has been made, and she remains unrelieved, hence, this writ petition is filed seeking the following reliefs:

“10.1 That, the Hon'ble Court may kindly be pleased to quash the order dated 30.09.2022 passed by the respondent no. 1 (Annexure P/2) and order dated 18.01.2023 passed 18/by respondent no.2 (Annexure P-1) and may kindly be further pleased to direct the respondents to not disturb the petitioner without extreme administrative exigency due to illness of her family member specially his father.

10.2 That, any other relief, which this Hon'ble Court may deem fit and proper under the facts and circumstances of this case, may also be granted to the petitioner.

10.3 That, the cost of the petition may also be granted.”

Vide order dated 02.02.2023, order of status quo was granted to the petitioner by this Court.

Considering the aforesaid aspect of the matter and considering the fact that on the strength of the aforesaid stay order, the petitioner is still continuing at her original place of posting, as such the order transferring the petitioners, by the afflux of time, has lost its efficacy and as such the orders dated 18.01.2023 and 30.09.2022 are required to be quashed and accordingly the said orders under challenge are hereby quashed.

However, liberty is granted to the respondent State authorities to pass appropriate orders in respect of transfer of the petitioner, in case exigency arises, without being influenced by this order.

With the aforesaid observations and directions, the writ petition is disposed of.
