By way of this petition, the petitioner has prayed for following

reliefs:-

“10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ/ order, thereby setting-aside/quashing the impugned select list (Annexure P/1) so far it relates to selection of respondents no. 5 to 8 on the post of Contract Lecturer, with all consequential proceedings and orders pursuant to the impugned selection list.

10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to select the petitioner for the post of Contract Lecturer Hindi subject and issue appointment order in favour of petitioner on the said post, in accordance with law.

10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”

Brief facts of the case, is that, on 26.07.2002, the authorities issued an advertisement for recruitment to the post of Contract Lecturer and other posts under Swami Aatmanand Utkrisht English Medium School for District Bastar, wherein Clause 5 specifically prescribed that priority would be given to local residents of District Bastar, and only in case of non-availability of eligible local candidates would candidates from other districts be considered. The advertisement was issued for filling up four posts of Lecturer in the Hindi subject in District Bastar, which are relevant for the purposes of this petition. It is stated that the petitioner, being duly qualified and eligible, submitted her application for the post of Lecturer (Hindi) and participated successfully in the selection process. Thereafter, respondent no. 4 issued the merit list of Contract Lecturers, in which the petitioner’s name appeared at serial no. 8, while the candidates at serial nos. 1 to 7 were not local residents of District Bastar; therefore, as per Clause 5 of the advertisement, the petitioner ranked as a meritorious local candidate. It is further submitted that respondents no. 5 to 8 were placed at serial nos. 12, 2, 4, and 19 respectively in the merit list, wherein respondents no. 6

and 7 were not local residents of District Bastar and respondents no. 5 and 8 were less meritorious than the petitioner, their names appearing below hers in the list. Despite this, respondent no. 4 issued the impugned select list whereby respondents no. 5 to 8 were illegally selected for the post of Contract Lecturer, thereby depriving the petitioner, a meritorious local candidate, of her rightful selection

Learned counsel for the respondent/State, at the very outset, submits that the controversy sought to be raised in the present writ petition is no longer res integra, in as much as the same issue has already been comprehensively considered and decided by the Hon’ble Division Bench of this Court in WPS No. 1081 of 2020. He further submits that the judgment rendered in the said matter squarely covers the present case on all material aspects, thereby leaving no surviving question requiring fresh adjudication by this Court. In view of the authoritative pronouncement already holding the field, it is submitted that the present petition deserves to be disposed of in terms of the aforesaid decision without entering into a detailed examination on merits.
