1. This petition has been preferred preferred by the petitioner under Article 226

of the Constitution of India by seeking following reliefs, which are as under:-

“10.1 That, the Hon’ble Court may kindly be pleased to direct the respondent authorities to consider the petitioner for promotion.

pleased to direct the respondent authorities to decide the pending representation of the petitioner within stipulated time.

10.3 Any appropriate writ, direction or order may also kindly be passed in favour of the petitioners, which this Hon’ble Court deems fit in the circumstances of the case. ”

2. Counsel for the petitioner submits that this petition has been filed for grant of promotion and for that a representation (Annexure-P/5) has already been filed before the respondent authorities. The limited prayer of the petitioner is that respondent authorities may be directed to decide the representation of him.

3. On the other hand, State counsel submits that though promotion has already been granted to others, however, since the limited prayer has been made by the petitioner to decide the representation, the same shall be considered and decided in accordance with law.

4. I have heard learned counsel for the parties and perused the material available on record.

Considering the submissions made by the parties, respondent authorities are directed to consider and decide the representation (Annexure-P/5) of the petitioner, as early as possible, preferably within a period of 45 days from from the date of receipt/submission of copy of this order, in accordance with law.

6. With aforesaid observations and directions, this petition stands disposed of.

7. Interlocutory application(s) pending, if any, also stands disposed of.

8. It is made clear that this Court has not made any observation on the merit of the case.
