Heard Mr. Vijay K. Deshmukh, learned counsel petitioners as well as Mr. Vinod Deshmukh, learned counsel for the respondent/s.

By way of this writ petition, the petitioners have prayed for following reliefs:

“10.1 Your Lordships may be please to issue a writ of certiorari calling for the records relating to the issuance writ petition.

10.2 Your Lordships may be please to issue a writ of mandamus or any other appropriate order or direction thereby set-aside the impugned arbitrary action and directed to decide the present petitioner Representation/Appeal dated 17/01/2024 Annexure P/1 filed before the respondent no. R/2 the ChairmanCum-Managing Director SECL Bilaspur within filed by the petitioner no. 01 for his compassionate appointment within the stipulated period.

10.3 Your Lordships may be please to direct the respondent's i.e., the Coal India/S.E.C.L. be directed to set aside the letters/orders dated 27/06/2023 & 25/07/2023 passed by the respondent R/4 to order to appear before the age determination committee for the age of present petitioner no. 01 although petitioner no. 01 has his School Dakhil Kharij Register Annexure P/3, Class-V Mark Sheet Annexure P/4, School Transfer Certificate dated 12/09/2022 Annexure P/5 on which petitioner no. 01 Date of Birth is already mentioned i.e. 08/04/1993.

10.4 Your Lordships may be please to grant any other relief as your lordship may deem fit.”

Learned counsel for the petitioners submits that the matter relates to dispute regarding determination of age and according to respondents they are ready to initiate age determination proceedings. The petitioners are also ready to appear before the Age Determination Committee for determination of his age.

Learned counsel for the respondent/SECL has not opposed the submissions advanced by the learned counsel for the petitioners.

Accordingly, the petitioners are directed to appear before the concerned Age Determination Committee (ADC) on a date given by the respondent/SECL and the respondents are directed to consider the grievance of the petitioner and to pass appropriate orders in respect of age of the petitioners after considering his entire documents in respect of his age.

With the aforesaid observations and directions, this petition stands
