By the present writ petition, the petitioner is retired Assistant Engineer who retired from service after filing of this writ petition, is seeking a direction towards the respondents to convene the meeting of Review Departmental Promotion Committee (DPC) for promotion to the post of Executive Engineer with effect from 2008.

Learned counsel for the petitioner submits that the petitioner has already submitted a representation Annexure P-7 to the Secretary, Public Works Department on 19/11/2024 by raising his grievance and requesting to convey review DPC and to grant promotion from the date when the persons junior to the petitioner have been promoted. Learned counsel for the petitioner submits that the writ petition be disposed of with a direction to the respondent/Secretary to consider the representation submitted by the petitioner in accordance with law within a stipulated period.

Learned counsel for the State/respondent No.1 submits that if the representation of the petitioner is still pending before the respondent No.1, the same shall be considered in accordance with law within a period of 50 days.

I have heard learned counsel for the parties, perused the pleadings and documents.

It appears that the petitioner has submitted a representation to the Secretary, Public Works Department, when he was in service and requested for review DPC as well as grant of promotion from the date when the persons junior to the petitioner were granted promotion, however, the said representation is still pending and

the same has not been decided till date, hence, the writ petition is disposed of with a direction to the respondent No.1/Secretary, Public Works Department to decide the representation in accordance with law within a period of 50 days from the date of receipt of copy of this order.

With the aforesaid observation and direction, the writ petition stands disposed of.
