The petitioner, Hari Ram Dhruw, a Public Works Department employee aged about 61 years due to retire on superannuation in May 2025 (as submitted by his counsel), had challenged the order dated 30-11-2024 transferring him from Durg Circle to the office of the Engineer-in-Chief, PWD, Raipur, and the order dated 10-1-2025 rejecting his representation against it. His earlier writ petition WPS No.7961 of 2024 had been disposed of with liberty to make a fresh representation, and WA No.903 of 2024 against that disposal was dismissed by the Division Bench. Learned counsel for the State, on instructions, informed the Court that the petitioner had already joined at the transferred place of posting on 14-1-2025; the petitioner's counsel submitted he had joined under pressure. At the very outset, learned counsel appearing for the State, on instructions, would submit that albeit the petitioner is questioning the order 10-1-2025 by which the representation of the petitioner has been rejected and the order dated 30-11-2024 whereby the petitioner has been

transferred from Durg Circle to the office of the Engineer-in-Chief, Public Works Department, Raipur, Atal Nagar, Nawa Raipur, the petitioner has already joined at the transferred place of posting on 14-1-2025 and, as such, nothing remains in this petition for adjudication.

At this juncture, learned counsel appearing for the petitioner would submit that the petitioner has joined at the transferred place under pressure, as he is going to retire from service in the month of May, 2025 on attaining the age of superannuation.

I have heard learned counsel appearing for the parties and perused the documents.

Earlier the petitioner has preferred WPS No.7961 of 2024 which was disposed of granting liberty to the petitioner to make a fresh representation before the authorities. Thereagainst WA No.903 of 2024 preferred by the petitioner, which was dismissed by the Division Bench of this Court. Even the representation preferred by the petitioner has also been rejected by order dated 10-1-2025. Subsequently, in compliance of the transfer order dated 30-11-2024, according to the learned counsel for the State, the petitioner joined at the transferred place of posting on 14-1-2025.

In view of foregoing, nothing survives in this petition for adjudication and accordingly it is dismissed.
