The petitioner by way of this petition seeks a direction to the respondents to consider her case for grant of compassionate appointment.

The petitioner is the married daughter of late Ganesh Rampurik. The father of the petitioner i.e. Ganesh Rampurik, while working as Teacher (Panchayat) in the office of respondents died in harness on 23/03/2014. The petitioner is the sole dependent of the deceased employee. Therefore, she moved an application for grant of compassionate appointment on 15/06/2015 and the said application of the petitioner has been rejected on 18/11/2020 on the ground of married daughter.

Learned counsel for the petitioner submits that the issue whether married daughter would be entitled for compassionate appointment or not is no longer res-integra as the said issue has already been considered and decided on 30.11.2015 by this court in Writ Petition (S) No.296 of 2014 (Smt. Sarojni Bhoi Vs. State of Chhattisgarh & Others) and as such, the present writ petition is squarely covered by the said decision.

It is further informed by the petitioner that pursuant to the decision of this High Court, the policy of the State Government itself has been modified and amended to the extent that the married

daughters have also been held eligible for compassionate appointment.

In view of the aforesaid factual matrix of the case, this court is of the opinion that ends of justice would meet if this court is disposed of with a direction to the respondent No.1 to take an appropriate decision on petitioner's claim for grant of compassionate appointment keeping in view the decision of this court in case of Smt. Sarojni Bhoi (Supra) as well as subsequent modification that has been brought in respect of the policy of the compassionate appointment of the State Government.

It is ordered accordingly.

Let a suitable decision be taken by the respondent No.1 in this regard within a period of four months from the date of production of a copy of this order.

With the aforesaid direction, the petition stands disposed of.
