Heard Shri Prasun Bhaduri, learned counsel for the petitioner. Also heard Shri SS Baghel, learned Dy GA, appearing for the respondents/State.

The petitioner has filed the present petition for the following reliefs:-

“10.1) That this Hon’ble Court may kindly bepleased toissue an appropriate writ, order, or direction restraining the respondent no.4 from registering an FIR against the petitioner based on the communication dated 16.12.2024.

10.2) That the Hon’ble Court may kindly be pleased to quash the communication letter dated 16.12.2024 passed by respondent no.2.

10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief9s) as deemed fit and proper in the interest of justice. ”

Learned counsel for the State would submit that on 5^th January, 2025, the Station House Officer concerned has received copy of the impugned order dated 16.12.2024 through the Office of the Superintendent of Police, by which he was requested to lodge FIR against the petitioner, and he will do the needful in this regard in accordance with law.

Learned counsel for the petitioner would submit that petitioner also lodged a written complaint to the Station House Officer, PS-Lailunga, against the Eklavya Computer Education, Lailunga, Raigarh for registering FIR but no action was taken by the respondent/State.

Considering the submissions made by learned counsel for the parties, and further considering the documents annexed with the petition, we do not find any sufficient ground to interfere with the petition, as the concerned Police has received the request letter for lodging of the FIR on 5 th January, 2025 itself, and the allegation requires proper investigation. Therefore, the present petition is dismissed. However, petitioner is at liberty to take recourse of law if occasion arises, and if so advised.
