1. Counsel for the Petitioner prays for the following relief(s):-

(i)That, this Hon’ble Court may kindly be pleased to issue a writ/ writs, order/orders, direction/directions, directing the Sub- Registrar, Korba to register and mutate the sale deed executed between the petitioner and the buyer as the directions issued by the Collector, Korba, and Sta# O%cer SECL, are not applicable to the petitioner’s transaction.

(ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.

Learned counsel for the petitioner submits that the petitioner is the owner of land bearing Khasra No., 149/2, 168 and 192/2 total area 0.445 hectare situated in Gram Raliya, Dipika Tehsil Dipka District Korba Chhattisgarh. The petitioner has entered into an agreement along with the respondent No. 8 for sale of the said land for total consideration amount of Rs. 5,10,000/- and the petitioner has also received the entire consideration amount of sale i.e. Rs. 5,10,000/through cheque No. 924203 on 10.01.2025 from the respondent No. 8.

Learned counsel for the petitioner further submits that the petitioner has made an application before the Sub-Registrar, Korba for registration of the said land but the said request has been denied by the sub-registrar by giving the reference to the directions given by the Collector, Korba on 23.10.2024 and as per the direction of Sta0 O1cer (Revenue Department), SECL on 30.04.2024. Moreover, the direction given by the Collector Korba and Sta0 O1cer, SECL, it has been directed to the various authorities of revenue department not to proceed with the registration process of the land which is being sell in small parts to the buyers as there was a several increase in the illegal conversion of land and illegal plotting on agricultural land of the farmers.

Therefore, he prays for a direction to the Sub-Registrar Korba to register the sale deed executed between the petitioner and the buyer as the directions issued by the Collector Korba and Sta0 O1cer SECL.

4. Learned State Counsel submits that the direction issued by the Collector Korba dated 23.10.2024 is not applicable to the case of the present petition, since the portion of land i.e. 0.445 hectare which is being sold by the petitioner, is not a small part of land.

5. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case instead of keeping this petition pending, I 2nd it appropriate to dispose of the same at this stage directing the Sub-Registrar Korba to consider the application of the petitioner for registration the sale deed which has been executed between the petitioner and the respondent No. 8 in accordance with law, if there is no legal impediment.

7. With the aforesaid direction, the writ petition is disposed of.
