By the present writ petition, the petitioner is seeking a direction towards the respondents for payment of compensation towards the land bearing Khasra No.142/76, area of 2 decimals of said land which has been used by the respondents authorities for construction of road National Highway No.343.

Learned counsel for the petitioner submits that the land in question has been utilized for construction of road N.H. No.343, however, no compensation has been paid to the petitioner till date, though the adjacent land bearing Khasra Nos. 142/75 and 142/77 has been acquired and compensation has been awarded to the owner of the said land.

Learned counsel for the State/respondent submits that the SDO/respondent No.4 shall verify and examine the claim of the petitioner by making spot inspection to the land of the petitioner and if the land of the petitioner is found to be utilized for the construction of the road, necessary steps shall be taken for acquisition of the land and payment of compensation towards the said land.

I have heard learned counsel for the parties and perused the pleadings as well as the documents placed by the petitioner in this petition.

The petitioner is claiming that the land bearing Khasra No.142/76, 2 decimals land out of the said Khasra number has

been utilized by the respondents for construction of road, however, no compensation has been paid to the petitioner, hence, the respondent No.4/SDO is directed to verify and examine the claim of the petitioner by making spot inspection to the land of the petitioner, within a period of ninety days and if it is found that the petitioner’s land has been utilized for construction of the road, necessary steps be taken for acquisition of the same and the payment of the compensation be made to the petitioner, in accordance with law.

With the aforesaid observation and direction, the writ petition stands disposed of.
