By the present writ petition, the petitioner is seeking a direction towards the respondent authority particularly Municipal Corporation to re-locate the cattle to a designated area outside the residential colony.

Learned counsel for the petitioners would submit that the petitioners are resident of residential colony, aggrieved by the inaction on the part of the respondent particularly the Municipal Corporation who are not taking any steps on the complaint that some of the resident are unlawfully operating dairies from their house situated in the residential colony and because of the said continuance of dairies in the residential colony the petitioners are facing hardships. Learned counsel for the petitioners submits that the petitioners have

submitted a representation before the Commissioner to take steps to redress the grievance of the petitioners.

Learned counsel appearing for the Municipal Corporation would submits that as the petitioners’ representation is pending before the Commissioner, the same shall be considered and necessary steps will be taken within a stipulated period.

I have heard both the counsels for the parties.

In view of the submissions made by the learned Senior Counsel appearing for Municipal Corporation, it is directed that the representation pending before the Commissioner be decided and necessary steps shall be taken to redress the grievance of the petitioners within a period of 45 days by giving sufÏcient opportunity of hearing to all the effected parties.

With the aforesaid direction, the writ petition is disposed of.
