By way of the present petition, the petitioner has prayed for the following reliefs:-

a. That the Hon’ble Court may kindly be pleased to allow the petition by declaring action of respondent no. 2 is wrong, illegal and condemnable for keeping the case undated from 20.06.2024 till date, therefore suitable direction to decide the case by taking into admission of respondent no. 3 in order sheet dated 20.06.2024, within stipulated period with costs, in the interest of justice.

b. Any other relief or direction which the Hon’ble Court may deems fit, be also awarded.

At the very outset learned counsel for the respondent contended that the instant petition may be disposed of with a direction to the concerned Tehsildar, Bhatapara to decide the case No.202007212500013 (Annexure P/2) within a stipulated time period.

Considering the relief prayed for by the petitioner as well as the submission made by learned counsel for the respondent No.3, it is directed that the concerned Tehsildar shall decide the case bearing No.202007212500013 (Annexure P/2) expeditiously as soon as possible preferably within a period of six months from the date of receipt of copy of this order after giving opportunity of hearing to the private respondents.

It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall proceed in accordance with law.
