1. At the outset, the victim appears with covered face along with her father through video conferencing and they object grant of bail to the applicant.

2. The applicant has preferred this Second Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for

grant of regular bail, as he has been arrested in connection with Crime No.607/2024, registered at Police Station Kharora, District Raipur (C.G.) for offences punishable under Sections 64(2)(f), 351(3) of the Bhartiya Nagarik Suraksha Sanhita and Section 4 of the Protection of Children from Sexual Offences Act. His first bail application, i.e., M.Cr.C. No.9027 of 2024 was dismissed as withdrawn by this Court vide order dated 22.1.2025.

Learned counsel for the applicant submits that the prosecutrix (PW1) lodged First Information Report on 9.9.2024 alleging that on 5.9.2024 the present applicant, who is her brother-in-law, took her to his house in the name of issuance of caste certificate. After reaching his house, she found that one old person was present in the house. The applicant asked that old person to go outside. When that person went outside, taking advantage of the situation, the applicant tried to sexually molest the prosecutrix. Therefore, the aforesaid offences were registered against the applicant. Learned counsel for the applicant further contended that the date of alleged incident is 5.9.2024, but, the FIR has been lodged by the victim on 9.9.2024. The applicant has been arrested on 10.9.2024 and he is still in jail. Charge-sheet has been filed and material witnesses have been examined.

4. Learned counsel for the State opposes the bail application. The victim along with her father also raised objection against grant of bail to the applicant.

5. I have heard the submissions put-forth on behalf of the parties.

6. Looking to the entire facts and circumstances of the case, particularly, that the applicant is brother-in-law of the

prosecutrix/victim and he has committed rape with her, who was minor at the time of incident and material witnesses have been examined, therefore, I am not inclined to allow the bail application. Accordingly, the bail application is rejected.

7. However, the Trial Court is directed to expedite the trial and conclude the same expeditiously if there is no legal impediment.
