Learned counsel for the appellant submits that he has filed fresh affidavit of the friend of the applicant with covering memo today itself i.e. on 13.11.2025, as such he has removed the default as pointed out by the Registry.

Perused the covering memo dated 13.11.2025 and affidavit dated 04.11.2025 of the friend of the appellant. The default as pointed out by the office has been removed.

Now this Court proceeds to hear the instant bail application.

The applicant has preferred this first bail application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he is arrested in connection with Crime No. 03/2021 registered at Police Station – Asta, District Jashpur (C.G.) for the offence punishable under Sections 420/34 of the IPC.

The prosecution case, in brief, is that the applicant and other co-accused persons namely Rajendra Singh and Surajmani Bhagat helped different women self-group in obtaining loan from Spandana Company and Bharat Finance Company. When the loan amount was deposited in the bank account, an amount of Rs.20,000/- - Rs.25,000/was taken from the woman/complainants on the pretext of investing the same in the company styled as ‘One Click Shop’ and assurance was given by the applicant and coaccused that the installments of the same would be paid by them. The allegation against the present applicant and coaccused is that they stopped paying the installments of the concerned bank and the bankers started harassing the complainants for loan payment, thereby the applicant committed fraud with the complainants. Based on this, offence has been registered against the applicant.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. Learned counsel also submits that vide order dated 06.08.2022, similarly situated other co-accused persons namely Rajendra Singh and Surajmani Bhagat, whose names find place in FIR, have been granted bail by

the learned Trial Court. Learned counsel also submits that the applicant is in custody since 14.07.2025, charge sheet has been filed, the offence is triable by Magistrate and there is no likelihood of the case being decided in near future, therefore, the applicant may be extended privilege of regular bail.

Learned State counsel opposes the bail application.

Considering the totality of the facts and circumstances of the case and further considering the fact that co-accused persons namely Rajendra Singh and Surajmani have been granted bail by the learned Trial Court, the applicant is in jail since 14.07.2025, charge sheet has been filed, the offence is triable by Magistrate and the trial may take some time, without commenting anything on merit of the case, I am inclined to release the applicant on regular bail.

Accordingly, the instant bail application is allowed.

It is directed that the Applicant shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the trial Court for his appearance before the said Court as and when directed.
