2. The present petition has been filed by the petitioner with the following prayer:

“ It is, therefore, prayed that this Hon’ble Court may kindly be pleased to quash the FIR bearing Crime No. 114 of 2022 dated 13.04.2022 (Annexure P/3) and entire charge-sheet dated 11.06.2022 (Annexure P/2) filed before the Court of Chief Judicial Magistrate, Jashpur, District Jashpur (C.G.) under Section 420 & 120B of Indian Penal Code by the respondent and consequential entire criminal proceedings pending against the present petitioner bearing Criminal Case No. 324 of 2022 pending before the Court of Chief Judicial Magistrate, Jashpur, District Jashpur, Chhattisgarh (Annexure P/1), in the larger interest of justice. ”

Learned State counsel submits that in the present case, charges have already been framed against the petitioner and five prosecution witnesses have been examined by the learned trial Court, and the trial is presently in progress. In view thereof, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition.

4. In light of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn . Needless to observe, we hope and trust that the learned trial Court shall make an earnest endeavour to conclude the trial expeditiously, in accordance with law, subject to there being no legal impediment.
