Heard Mr. Abhyuday Tripathi, learned counsels for the petitioner. Also heard Mr. S.S. Baghel, learned Government Advocate for the respondents / State and Mr. Rajkumar Sahu for respondent No. 2.

The petitioner has filed this petition praying for following relief:-

“It is therefore prayed that the Hon'ble Court may be king enough to allow the petition and to quash the impugned FIR and chagesheet filed against her in the interest of Justice.”

Learned counsel for the petitioner would submit that the petitioner filed the present writ petition for quashment of the FIR No. 103/2021 dated 09.02.2021 registered at Police Station Bemetara, District Bemetara, which was filed by the respondent No. 2 (mother-in-law of the petitioner). He would further submit that during pendency of the present writ petition the police filed the charge sheet for which the petitioner filed an application for amendment.

Learned counsel for the respondent No. 2 would submit that the petitioner herein also lodged the FIR against the respondent No. 2 and her family members.

At this stage, learned counsel for the State would submit that since the petition is pending consideration since 2021 and in the meanwhile the charge sheet has been filed and subsequent

development also took place further pursuant to the charge sheet.

At this juncture, learned counsel for the petitioner would seek permission of this court to withdraw the present CRMP with liberty to file a fresh petition, if so advised, by taking all the facts, grounds and the latest development of the case.

Accordingly, this petition is dismissed as withdrawn , with liberty as stated supra.

Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same. Sd/-
