1. Heard Mr. Roop Ram Naik, learned counsel for the petitioner. Also heard Mr. Sakib Ahmed, learned Panel Lawyer for respondent

2. The petitioner has filed this petition praying for following relief:-

“It is, therefore, prayed that this Hon'ble Court may kindly be pleased to allow the instant petition and set aside/ quash the FIR/Crime No.116/2020 and final report registered by Police Station Kosir, District Sarangarh-Bilaigarh (C.G.) against the petitioner/accused for offence under Section 354, 506, 323 of IPC (Annexure P-1) and also set aside the criminal proceeding vide Criminal Case No. 268/2021 pending before the learned Judicial Magistrate First Class, Sarangarh, District Sarangarh-Bilaigarh (C.G.) (Annexure P-2) and this Hon'ble court may passed appropriate order which may deems fit in the circumstances of the case, in the interest of justice.”

3. Learned State counsel submits that the matter if fixed for framing of charge on 12.09.2025, hence no interference is sought for at this stage.

4. Learned counsel for the petitioner prays to withdraw the present petition with liberty to the petitioner to move an appropriate application before the concerned trial Court for discharge.

5. In view of the same, as prayed by learned counsel for the petitioner, this petition is dismissed as withdrawn , with liberty to take recourse to law.

6. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same.
