Examining the facts in light of the Supreme Court principles, the Court found that the respondent/accused, examining himself, took the plea that his friend Sahid Khan @ Kaju purchased an Activa vehicle on finance from Rohit Auto, Utai and that he, being a guarantor, gave the cheque; he stated he was only a driver and never purchased goods from the complainant's shop, and in cross-examination the complainant gave no suggestion that the respondent was not working as Driver.
