1. At the outset, learned counsel for the petitioner seeks to withdraw this petition. He would submit that the matter in issue relates to the transfer order issued by respondent No. 2/Chief Executive Officer, Jila Panchayat, Raipur and

the said authority is not competent to pass the said order. In Writ Appeal No.821/2018, the said question directly came before the Division Bench and it has been held that the power of transfer will vest in the Chief Executive Officer of the Zila Panchayat and such order of transfer shall be a valid exercise of power.
2. The other side did not oppose the submission put forth by the learned counsel for the petitioner.
3. In view of the aforesaid submission, the counsel is permitted to withdraw this petition.
4. Accordingly the writ petition is dismissed as withdrawn.
