5 Brief facts relevant for disposal of this petitioner are that the petitioners were initially engaged as daily wage employees by the respondents-Department. From the pleadings in the writ petition, it is appearing that they were engaged prior to the year 1990 and from the contents of the order Annexure P-1 it is reflecting that they were engaged in the year 1982 & 1984 and earlier they were discontinued in the year 2001 & 2004. Discontinuation of the petitioners from their employment as daily wage employees was put to challenge before Labour Court, Rajnandgaon which was allowed in favour of petitioners vide order dated 28.04.2008. Pursuant thereto petitioners were re-engaged in services on 19.11.2008 and since then they are continuously working as daily wage employees in the respondents-Department. Petitioners have submitted an application for their regularization in the respondent-Department pursuant to the Circular issued by the State Government dated 05.03.2008, however, their claim was not considered which made the petitioners to approach this Court by way of filing writ petition bearing WPS No. 8619/2022, which was disposed off on 07.12.2022 permitting the petitioners therein to submit fresh representation before Respondents No. 1 & 2 therein and direction was issued to consider and decide the representation within specified time frame, keeping in mind the decision of Division Bench in WPS No. 1703/2015 dated 16.05.2017. Thereafter the respondents have taken decision vide Annexure P-1 on 20.01.2023 and has rejected the claim only observing that the writ petition bearing WPL No. 7235/2008 challenging the order passed by the Labour Court dated 28.04.2008 by which the petitioners were re-engaged as daily wage employees is pending consideration in High Court.
