on the post of Medical Social Worker. Said representation of petitioner came to be rejected vide order impugned, Annexure P-9, on the ground that petitioner does not possess the requisite educational qualification prescribed in the advertisement for appointment to the post in question. He submits that petitioner is having post-graduate degree in Social Work with one of the subject namely Medical Social Work and as such, the petitioner is having higher qualification in comparison to qualification of Diploma in Medical Social Worker and therefore, the petitioner cannot be debarred from being appointed merely because he is not having qualification of Diploma in Medical Social Worker. He further submits that initially when petitioner appeared in written examination, the Selection Committee did not raise this objection and only after passing of the order by the Coordinate Bench in favour of petitioner, the Selection Committee has declared the petitioner ineligible on such a frivolous ground, which is nothing but an afterthought in order to deprive him of his legitimate right for appointment when he has come out successful in selection process and just to accommodate respondent No.4.
