This petition has been filed by the petitioner seeking a directions to the respondents authority to grant benefits of 3^rd Time Bound Pay Scale in light of circular dated 08.08.2018. 2. Learned counsel for the petitioner submits that the petitioner entered into the service

with the respondents in the year 1980 and retired in the year 2023 on attaining the age of

superannuation. He submits that the circular dated 08.08.2018 was issued by the respondent authority by which benefits of 3^rd Time Bound Pay Scale was extended to the employees who have completed 30 years of service. He further submits that the petitioner had already completed more then 40 years of service, however, the said benefit was not extended to the petitioner. He submits that the petitioner made a representation in this regard to the respondent No. 2 on 20.04.2023 (Annexure P-3). However, after laps of one year, the petitioner has not been extended the benefits. He submits that for the present, the writ petition may be disposed of permitting the petitioner to submits a fresh representation to respondent No. 2 and the respondent No. 2 may be directed to decide the same within a reasonable period of time.

Per contra, Ms. Trivedi submits that the petitioner services of almost 3 years was declared as dies-non and therefore, at this stage which cannot be said that the case of the petitioner can be considered for grant of 3^rd Time Bound Pay Scale.

Be that as it may, having thus considered the submissions of learned counsel for the parties and on perusal of record, this Court is of the opinion that this petition can be disposed of by permitting the petitioner to make representation to respondent No. 2 with regard to grievances as projected in the writ petition and all relevant documents if any, within a period of 30 days from the date of receipt of copy of this order. On such representation is made to respondent No. 2, it is expected that the same shall be decided within a further period of 120 days from the date of presentation of the such representation.

With these observations, the writ petition is disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case. 6. If any adverse order is passed against the Petitioner, he would be at liberty to move afresh before this Court.
